{"id":703,"date":"2018-01-15T16:59:01","date_gmt":"2018-01-15T22:59:01","guid":{"rendered":"http:\/\/pkeating.com\/?p=703"},"modified":"2018-01-15T16:59:01","modified_gmt":"2018-01-15T22:59:01","slug":"trade-secret-licensees","status":"publish","type":"post","link":"https:\/\/pkeating.com\/?p=703","title":{"rendered":"Trade Secret Licensees"},"content":{"rendered":"<p>Last May, I <a href=\"http:\/\/pkeating.com\/?p=646#more-646\">wrote<\/a> about an amendment to the Texas Uniform Trade Secret Act (\u201cTUTSA\u201d) that would become effective on September 1, 2017.\u00a0 Now that the amendment is in effect, I looked back at one of the changes to the statute caused by the amendment that\u00a0should bolster trade secret licensees\u2019 efforts to assert theft of trade secret claims. The counter-argument would be that only the owner of the trade secret is entitled to assert the claim.<\/p>\n<p>Prior to the 2017 amendment, TUTSA did not include a definition of \u201cowner.\u201d However, the statute did include several references to owners of trade secrets.<\/p>\n<p>The 2017 amendment added a definition of \u201cowner\u201d that includes within the definition someone who possesses the \u201cright to enforce rights\u201d in the trade secret.
