{"id":657,"date":"2017-06-21T10:43:06","date_gmt":"2017-06-21T16:43:06","guid":{"rendered":"http:\/\/pkeating.com\/?p=657"},"modified":"2018-04-02T11:06:11","modified_gmt":"2018-04-02T17:06:11","slug":"the-tcpa-statute-and-trade-secrets","status":"publish","type":"post","link":"https:\/\/pkeating.com\/?p=657","title":{"rendered":"The TCPA Statute and Trade Secrets"},"content":{"rendered":"<p>The Texas Citizens Participation Act (\u201cTCPA\u201d) is a statute in Texas that provides protection from frivolous lawsuits to people exercising their U.S. Constitution First Amendment rights.\u00a0 The law provides a defendant who is sued for exercising the First Amendment right to freedom of speech, freedom of association or the right to petition the government the ability to file a motion to dismiss the lawsuit at the outset of the case. \u00a0The statute provides that the case shall be dismissed unless the plaintiff presents the court with evidence establishing a \u201cprima facie case for each element of the claim in question.\u201d<\/p>\n<p>Zach Wolfe is in the midst of an interesting <a href=\"https:\/\/fiveminutelaw.com\/2017\/05\/30\/slapp-in-the-face-to-texas-trade-secrets-lawsuits-part-1\/\">three-part blog post series<\/a> in which he discusses a May 2017 decision by the Austin Court of Appeals, <a href=\"https:\/\/scholar.google.com\/scholar_case?case=1820120709330515010&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\"><em>Elite Auto Body, LLC v. Autocraft Bodywerks, Inc.<\/em>, No. 03-15-00064-CV, 2017 WL 1833495 (Tex.
