{"id":536,"date":"2016-09-08T14:22:17","date_gmt":"2016-09-08T20:22:17","guid":{"rendered":"http:\/\/pkeating.com\/?p=536"},"modified":"2016-09-08T14:22:17","modified_gmt":"2016-09-08T20:22:17","slug":"preemption-its-not-just-for-the-feds","status":"publish","type":"post","link":"https:\/\/pkeating.com\/?p=536","title":{"rendered":"Preemption: It\u2019s Not Just for the Feds"},"content":{"rendered":"<p>Attorneys representing plaintiffs in theft of trade secrets lawsuits frequently use the \u201ckitchen sink\u201d approach when selecting the legal causes of action to assert on behalf of their clients.\u00a0 In addition to a theft of trade secrets claim arising under the Texas Uniform Trade Secrets Act (\u201cTUTSA\u201d), lawyers tend to also assert alternative claims based upon the alleged theft of the trade secrets.\u00a0 Examples of alternative claims are conversion, unjust enrichment and unfair competition.<\/p>\n<p>As the saying goes, the fact that everyone does it does not make it right.<\/p>\n<p>Section 134A.007 of TUTSA states that \u2013 with few exceptions &#8212; \u00a0the statute replaces other Texas law providing a remedy for misappropriation of a trade secret.\u00a0 This is known as preemption.\u00a0 You might expect defendants in TUTSA lawsuits to frequently raise preemption as a basis for dismissing some of the claims asserted against them.\u00a0 Yet if they are, the issue is not making it into the case law.<\/p>\n<p>I was only able to find one case considering the extent to which TUTSA preempts other legal claims.\u00a0 In March 2016, United States District Judge Sam Sparks issued an opinion holding that TUTSA preempts a plaintiff\u2019s alternative legal claims unless the plaintiff can show that the alternative claim is based on facts unrelated to the misappropriation of the trade secret.\u00a0 That opinion is <a href=\"http:\/\/law.justia.com\/cases\/federal\/district-courts\/texas\/txwdce\/1:2014cv00847\/713632\/117\/\"><em>360 Mortgage Group, LLC v. Homebridge Financial Services, Inc.<\/em>, No. A-14-CA-00847-SS, 2016 WL 900577 (March 2, 2016 W.D.
